CFTC Clears Wallets for Perps
CFTC staff issued a no-action position allowing wallets and passive software providers to offer regulated perpetual futures without broker registration, per Unchained Crypto and The Block, the agency's second developer-facing relief in two days after the SEC's tokenised-stock exemption. The relief carries conditions, including providers consenting to the CFTC's investigative and enforcement authority. As a staff position rather than a Commission rule, it can be withdrawn without formal process.
CFTC Relief: the good news can be taken back tomorrow
The catch is in the conditions.
To skip registering as a broker, a wallet or app builder files a notice with the CFTC agreeing to something specific: they consent to the agency's power to investigate and sue them for anything they do wrong.
The relief isn't a carve-out from oversight. It's a swap. You skip the paperwork of registration — and hand the regulator a signed invitation to come after you.
In return the CFTC gives a 'staff position' — the kind that can be withdrawn tomorrow, no vote, no process.
Promises are as easily broken as they are made.
