The Rules Arrive Without the Lock

Verified · 17 Sept 2026Institutional TransitionSep 17, 2026

Following the CLARITY Act's defeat, SEC Chair Paul Atkins signalled the agency will pursue crypto regulatory clarity with or without legislation, and the CFTC chairman affirmed the agency will write crypto rules independently, per Bitcoin Magazine and multiple outlets. Bernstein projected swift SEC and CFTC rulemaking and noted stablecoin rewards on idle balances continue unaddressed by statute, per The Block. Coverage flagged that agency guidance lacks a statute's durability and can be reversed by a future administration.

Rules Without Congress: better than the courtroom, weaker than the law

The bill died Tuesday. The rules are coming anyway.

Within a day, the SEC's chair said the agency will deliver clarity with or without Congress. The CFTC's chairman said his agency will write the rules itself.

So crypto gets regulated either way. What changed?

Permanence.

A statute survives the administration that passed it. Agency rules are different — the next chair, appointed by the next president, can rewrite them.

We made this exact argument about the Bitcoin reserve this week: it exists by executive order, undoable with one signature. The reserve bill's whole product was the lock.

Same logic here. CLARITY was the lock. The agencies are the signature.

For five years the industry's complaint was regulation by enforcement — rules discovered in court, after the fact. Then the fix: regulation by legislation. That died 49-50.

What's left is regulation by agency: better than the courtroom, weaker than the law.

Bernstein notes the defeat leaves stablecoin rewards untouched by any statute — the loophole the banks wanted closed now survives at an agency's pleasure.

Everything crypto wanted, it now holds on a lease.
